Open Theft
Elaborate? What are Open World games?

You're talking about sandbox games, right? Maybe it's because in games, people want to do what they can't do in life. Without linear goals, people do whatever they want, which is largely criminal in nature.
A more likely explanation though is that everyone is aping GTA. There are "open" games that don't involve crime.

and you can steal horses in Oblivion, although it generally dosn't work out too well for you.
And the theft system in Morrowind and Oblivion is a joke. It's the one beef i have with the games, the punishment is WAY too light, usually just a fine or something and surrender of stolen goods (which i've usually fenced anyway) And since i'm a thief, gold is WAY too easy to come by.

Part of being open concept / sandbox is the idea of doing criminal things, and therefore theft has to be a factor at some point. You can easily play Morrowind, or Oblivion, or just about any open concept game (with the obvious exceptions, like GTA) without doing anything criminal, hell some of them require it. For example, if you do evil things in Neverwinter Nights, you can't be a paladin. Same with games like KOTOR or Fable.

Well I was trying to thinking up a game design that for an open game that wasnt big on the theft side.
the super hero games work, however. im not going ot be using super heros who have no use for travel.
I think i got it all figured out it now tho.
